General terms and conditions Tegnest
This is the English version of our Dutch text. Both versions apply equally. If they differ, the text most favourable to you applies.
Version 2026-10-14.4, valid from 14 October 2026. Prices according to catalogue 2026-10-08.1.
Part A applies to everyone. If you are a consumer (you are not buying for your business or profession), the rules of Part B also apply. If Part B contradicts Part A, Part B prevails.
Part A — for everyone
1. Who we are and what the words mean
Tegnest is a trade name of Dario Albers (sole proprietorship), Vlierstraat 196, 7544 GJ Enschede, KvK (Dutch Chamber of Commerce) 42167593, VAT ID NL005551357B38, email hallo@tegnest.com, telephone +31 6 37 44 34 15. In these terms, this is referred to as "we".
- You / customer: whoever orders a website through our platform.
- Business customer: you order for your business or profession.
- Consumer: you do not order for your business or profession.
- Website: the website that the platform makes for you (1 page, or up to 5 pages).
- Hosting: the annual subscription that keeps your website online (see article 4).
- Add-on: an extra part of your website that you pay for per year, together with your hosting, such as the request form with inbox (see article 4.5).
- Small change: see article 4.3.
Other terms and conditions, including yours, do not apply.
2. How it works and when the contract is formed
- You choose a template, fill in the details of your business and choose a style.
- After your email address has been verified, our system writes the texts of your website once using AI (see article 6).
- You see the whole website. If you want something different, type what you want to change. The AI then adjusts the texts or the style. This is free, but there is a small budget for it per account. Once that is used up, you can no longer have anything adjusted before payment. The facts you filled in (such as name, address, telephone, services, prices and opening hours) cannot be changed after the writing. That is possible after payment: you then adjust them yourself, free of charge, in your account (article 4.3).
- If you are satisfied, you give your approval and pay. If you do not want the website as it is, you do not pay. You are then not bound to anything.
- Your approval remains valid for 30 days. If you do not pay within 30 days, the approval lapses.
- The contract is formed as soon as you have given your approval and your payment has succeeded. You then receive a confirmation by email, with these terms. If you order as a consumer, we only start once that confirmation has been sent.
- After your payment, your website is online immediately. A person on our team then checks it, within one working day after it goes online (see article 7). If our system flags your website, we check it first and then put it online. If something has to change, we take it offline (or keep it offline) and let you know immediately, with the reason. We do our best to complete such a check within 3 working days. If it takes longer, you can end the contract by email; you then get the full amount back. We only reject a website for a reason from article 7. If we reject your website at that first check, you get the full amount back and the contract ends. Your other statutory rights remain.
- After payment, you adjust your details, your own texts, photos, colours, fonts and blocks yourself, free of charge, in your account. If you want the AI to adjust texts or the style for you, you use AI changes. Anything you and the AI cannot do, we do: as a change by us, or with a proposal with a price (article 4.3).

What you pay per year in advance is, converted per month (incl. 21% VAT): hosting €3.63, request form and inbox €2.42, online appointments €6.05, Zorgeloos €9.68. The amounts incl. VAT in the table are with 21% Dutch VAT. If, as a consumer, the VAT of another EU country applies to you (article B1), you see the amounts with that VAT when ordering.
- With your first payment you pay for the website plus the first year of hosting: €67.76 (Website, 1 page) or €102.85 (up to 5 pages), including VAT. If you choose add-ons (article 4.5), you also pay for their set-up and their first year. If you choose the website of up to 5 pages with the request form (Vakman package), you get a €5.00 discount in the first year (€6.05 incl. VAT) and pay €143.99. After that, you pay €72.60 per year for hosting and request form together (equivalent to €6.05 per month). Consumers always see prices including the VAT that applies to them.
- You pay the first time via Mollie, for example with iDEAL. By doing so you also give a mandate for automatic direct debit (with iDEAL, a SEPA direct debit). That mandate is held by Mollie: Mollie is the creditor and, on our behalf, collects the hosting and your add-ons each following year, in one payment. Your bank statement therefore shows Mollie's creditor ID, our name and the reference of your mandate; you also receive these details in the confirmation of your order. At least 7 days before each direct debit you receive an email with the amount, what it covers and the date. If you pay the first time with a credit card (or PayPal), you thereby give permission for the hosting and your add-ons to be charged automatically to that card (or that PayPal account) each following year, via Mollie. In that case too, you receive an email with the amount and the date at least 7 days in advance. Stopping automatic payment is possible at any time, without cancelling: click "Stop automatic payment" in your account or email us. We then stop the mandate. Your contract simply continues; for a next year you then receive a payment link on the renewal date. If there is no mandate, we also send you a payment link on the renewal date. If you cancel the contract (articles 8.4 and B3), the mandate stops too: we charge nothing for the time after your end date, and when your contract ends, we revoke the mandate. We do not collect packages of changes by direct debit: you buy and pay for those in advance in your account, with a one-off payment via Mollie, for example with iDEAL (article 4.3).
- You pay the price that was stated at your approval. We only change the price for a following year if our costs demonstrably change (for example what our suppliers charge for hosting, domain names or email), or in line with the consumer price index (CPI) of CBS (Statistics Netherlands). We announce this at least 30 days in advance by email, in the reminder for the renewal, with the old and the new price and the reason. If you do not want the new price, you can end the contract before that price takes effect. This costs nothing: what you paid in advance for the period after that, you get back per day. As a consumer you can also cancel at any time after that, with immediate effect (article B3).
- You receive an invoice by email for every payment.
- Reversals. If you have a payment reversed (a direct debit via your bank, or another reversal or chargeback), this counts as not paying. Article 9 then applies from the day we hear of the reversal. Your right to have a direct debit reversed within 8 weeks without giving a reason remains. A reversal does not automatically make an amount that you actually owe no longer owed; your statutory defence remains.
- Registration of your domain name. If we register a new domain name for you, that registration is a separate service with its own price: €14.51 incl. VAT. You pay it separately, as its own line in your first payment next to the first year of hosting; that year of hosting then costs that much less (the total stays the amount in the table). We carry out that registration in full right at the start. If, as a consumer, you withdraw from the contract after we have already registered your domain name in your name, we withhold that amount. The domain name then remains yours (article B2.3 and B2.4). If you connect your own domain name, there is no such line and we withhold nothing.
4. What is included with hosting
4.1 Included
- One domain name in your name: a .nl domain name, or another extension we offer when you order (.com, .eu, .be, .de, .fr or .at). Or: you connect a domain name you already have, for the same price.
- An SSL certificate (https).
- Email forwarding: we forward mail to your domain (for example info@yourbusiness.nl) to an inbox you already have. You can have up to 3 addresses on your domain forwarded. We only start once the inbox the mail goes to has confirmed this with a link. This is not a mailbox: you cannot send with it and we do not store the mail. Our forwarding service only holds a message until it has been delivered, and keeps a record for a few days of which address it went to, what happened to it and how large it was. Forwarding is only possible with a domain name registered with us; all mail to that domain then comes in via us, so do not use this if you already have mailboxes on that domain. We do not forward a message larger than 4.5 MB; you then receive a notification with the sender and the subject. Forwarded mail reaches you as a new message from doorsturen@fwd.tegnestsites.com; with "Reply" you answer the original sender. We do not forward mail that fails the check of the sender's domain while that domain asks for such mail to be rejected (DMARC "reject"), nor more than 200 messages per address per day.
- Monitoring of whether your website is online (uptime).
- 10 GB of data traffic per month.
- 10 AI changes per calendar month and 3 changes by us per hosting year (article 4.3; with Zorgeloos 30 and 12, article 4.5).
- Basic support by email. We answer as quickly as we can, but not immediately and without a fixed response time.
4.2 Availability We do our best to keep your website online at all times. We do not promise uninterrupted operation. Maintenance and outages at parties we work with (such as hosting) can make your website temporarily unreachable. This also applies to email forwarding. If your email is important for your business, check now and then whether forwarding still works.
4.3 Adjusting your website after payment
Your details: free. You adjust your telephone number, WhatsApp, email address, address, opening hours, service area, services and prices, key benefits, your link for making an appointment and your social media yourself in your account. This costs nothing and is online immediately. You can save this up to 20 times per day.
Editing yourself: free. Under "Website bewerken" (edit website) in your account you also adjust yourself: texts you type yourself, placing your own photos, colours and fonts, the order of the blocks, removing or putting back blocks, and adding blocks from details you already have. If you can choose another design there, you choose from the designs for the same kind of website (a business, a personal site or a club). All of this is free and does not count as a change. You can save up to 30 times per day. We check texts you type yourself automatically (article 7.2); if something stands out, a person looks first and it only goes online after that. A person looks at your first own photos once (article 7.2); until that has happened, what you save waits for that check. We do not save a change that stops your website working as it should (for example without a way to reach you).
Small changes. A small change is one of these adjustments, on a website that is already online. There are two kinds:
- AI change: you describe what you want different and the AI adjusts it: the texts, the colours or style, the order of the blocks or the layout at the top. You first see a preview. That preview is free (up to 5 per day) and stays available for 24 hours. Only when you click "Apply" does it count as 1 AI change. Not applying it costs nothing. Your hosting includes 10 AI changes per calendar month (Dutch time). What you do not use in a month lapses at the end of that month. Once they are used up, we use the AI changes you bought. If you have none, you wait until the next month or buy a package;
- change by us: something the AI does not do. You then send a request from your account. When you send it, we set aside 1 change by us: first from the 3 per hosting year included with your hosting, then from what you bought (the oldest purchase first). That change only counts as used once we have delivered it. Included changes by us that you do not use lapse at the renewal, once the next year has been paid. You then get 3 again.
The following are not small changes: a new page, a new kind of block or function, a design for a different kind of website (or another design as long as you cannot choose it yourself), or having everything rewritten. For those, we first make you a proposal with a price.
Sometimes a person checks a change first (article 7.2). While that check is running, you cannot adjust your details and texts further (except during the check of your first own photos, see above). If we reject an AI change, or your contract ends before it could go online, you get that change back: an AI change of the month then does not count towards that month, a bought one you get back.
Buying packages. Want more? Then you buy a package in your account, only per package (not individually): 25 AI changes for €5 excl. VAT (€6.05 incl. VAT), 100 AI changes for €15 excl. VAT (€18.15 incl. VAT), 3 changes by us for €20 excl. VAT (€24.20 incl. VAT) or 10 changes by us for €60 excl. VAT (€72.60 incl. VAT). Bought AI changes only apply to AI changes, bought changes by us only to changes by us. You pay in advance, as a one-off payment via Mollie (for example with iDEAL). As soon as the payment has succeeded, you can use them. As a consumer you can use them as soon as we have sent you the confirmation of the purchase by email (article B2.7). Bought changes do not lapse at the renewal. After the end of the contract you can no longer use them. If you are a consumer, we refund the unused part of each package you bought, within 14 days after the end: in proportion to what you paid for that package, rounded in your favour. A request to us that has not been delivered yet, we cancel; it counts as unused. If you still owe us something, we may set it off. Within the withdrawal period, or if you withdraw from the whole contract, article B2.7 applies. Included changes and changes you received as a gift (article 4.7) are not paid out. Business customers get no money back for unused bought changes.
4.4 Data traffic If your website consistently uses more than 10 GB per month, we contact you and make a proposal. We do not count traffic caused by attacks or abuse. If we cannot reach agreement together, we may restrict your website.
4.5 Add-ons
What the request form with inbox is. A form on your website with which visitors request a quote or an appointment from you. You set which questions it contains yourself. We store the requests for you in your account (the inbox). For each request you receive an email, and if you switch this on, the requester receives an acknowledgement of receipt. We store requests until 12 months after the last activity, or shorter if you choose so. After that we delete them automatically.
What online appointments is. A block on your website with which visitors make an appointment with you themselves: they choose a service, a day and (if you work with times) a time, and fill in their name and email address. You set yourself which services, times, parts of the day and locations there are, and on which days you are closed. The appointments are in the calendar in your account; there you confirm or cancel them, and also enter appointments you make by telephone. The customer receives a confirmation with a link to cancel, and if you switch this on, a reminder the day before. We do not guarantee that customers turn up. We store appointments until 12 months after the date of the appointment, or shorter if you choose 3 or 6 months.
What Zorgeloos is. As long as Zorgeloos runs, your hosting includes 30 AI changes per calendar month (instead of 10) and 12 changes by us per hosting year (instead of 3), with the same rules as in article 4.3. If you switch on Zorgeloos in the middle of a hosting year, you receive extra changes by us for the rest of that year in proportion to the whole months you pay for (9 extra for a whole year, rounded). Those lapse together with the other included changes at the renewal. If Zorgeloos stops, then from the next month 10 AI changes per month apply again, and from the next renewal 3 changes by us per year again.
Per year, together with your hosting. You pay for an add-on per year in advance, on the same renewal date and in the same payment as your hosting. The reminders of article 8.3 list each add-on with its price. Article 3.3 (price for a new year) also applies to add-ons.
Switching on later. While your hosting is running, you can switch on an add-on in your account. You then pay once, via Mollie (for example with iDEAL): the set-up, plus the annual amount for the whole months remaining until your renewal date. You do not pay for the month in which you start. Example: your hosting renews on 6 October and you switch on the request form on 20 January. There are then 8 whole months remaining. You pay €18.15 for the set-up and 8/12 of €29.04 = €19.36, together €37.51 incl. VAT. After that, the request form renews together with your hosting, for €29.04 per year (equivalent to €2.42 per month). As a consumer, you switch on the add-on as soon as we have sent you the confirmation of the purchase by email (article B2.8).
Just before the renewal. From 30 days before your renewal date, the amount of the renewal is fixed. From then until the renewal, you cannot switch on an add-on, nor revoke your cancellation of an add-on. As a consumer, you can no longer switch on an add-on from 44 days before your renewal date, so that your withdrawal period (article B2.8) is over before the renewal. After the renewal it is possible again. Cancelling is always possible. If you cancel an add-on after the renewal has been announced, and nothing has been charged yet, we remove that add-on from the renewal. You then receive a new announcement with the lower amount. We only charge at least 7 days after that new announcement. If the charging had already started, we collect the renewal as announced and refund the annual amount of that add-on within 14 days after the renewal.
Cancelling. You cancel an add-on in your account, with the form "Cancel contracts here" (article 8.4) or by email. This works as with hosting (article 8.4 and 8.5): the add-on stays on until the end of the paid year, and you do not get a paid year back. For consumers, article B3 applies, per add-on. If you cancel your hosting, your add-ons stop at the same time as your hosting.
After the end of an add-on. The form or the appointments block disappears from your website. Requests and appointments that have already come in remain in your account until your retention period expires. Until then you can view, download and delete them. If the whole contract ends, article 10 applies.
Personal data. With the request form and with online appointments, we process data of your visitors on your behalf. You are the controller and we are the processor. The data processing agreement applies to this (article 12.2).
Other add-ons. We do not yet offer a web shop, your own mailbox, an extra language, a price list or extra pages. If they become available, they will be set out with their price and rules in these terms. The deposit (article 4.6) is not yet available to buy; article 4.6 applies from the day it is.
4.6 Deposit and online payment with your own Mollie account
What it is. With online appointments (article 4.5) you can ask for a deposit per service: a fixed amount or a percentage of the price, at most half of the price. The customer pays via Mollie when booking. As long as the payment has not come in, we hold the slot briefly (10 to 30 minutes, you choose); after that the reservation lapses. The add-on costs €24 per year (excl. VAT) and only works together with online appointments.
For businesses only. This add-on is only available to business customers. You need your own account with Mollie B.V. and for that you enter into a contract with Mollie yourself. We are not a party to that contract.
Who does what. You are the seller of your services and the recipient of the payments. The money goes from your customer via Mollie to your Mollie balance and from there to your bank account. We never receive or hold that money and we make no payouts. In the cases of point 4 below we can, however, have a refund made to your customer from your Mollie balance through the connection. Otherwise we only provide the technology: a connection with your Mollie account, which you switch on yourself and can always stop, in your account with us or at Mollie.
What we do with the connection, and only that:
- create deposits on your Mollie account and read their status;
- refund a deposit if your customer cancels online within your cancellation period, if you cancel the appointment, if the payment came in after the slot was already gone, or if you ask us to. Before each refund we check whether your available Mollie balance is high enough. If it is not, we do not refund and we let you know;
- read your organisation details, your website profiles, your balance and the status of your onboarding at Mollie.
We do not move any balance, do not make payouts and do not change your bank account or your payout schedule. We currently do not deduct any fees from your payments (no transaction fees from us). Should we ever want to, we will first agree this with you separately, with at least 30 days' prior notice and the right to cancel. Mollie charges its own fees to you.
Your responsibility. You determine your policy for deposits and cancellations and the text your customers see beforehand; we provide a sample text, which is not legal advice. You comply with the rules for consumers and with Mollie's terms, handle questions, complaints, refunds and reversals (chargebacks) from your customers, and keep enough balance on your Mollie account for refunds.
Indemnity. If Mollie recovers a refund or reversal to your customer from us, because there was not enough on your Mollie balance, you pay that amount back to us. We may set it off against what we still owe you. As long as you have not paid it, we may switch off the deposit on your website.
Switching off. We may switch off the deposit on your website immediately if Mollie restricts or closes your account, if we see abuse or prohibited services, or if we receive a notice to that effect that appears well-founded. We let you know why. Appointments are then made without a deposit again.
Outages. We do not guarantee that payment always works. Outages at Mollie are beyond our control. Article 13 applies.
End. If the add-on or the contract stops, we stop the connection and revoke our access at Mollie. Your Mollie account and your balance remain yours. If anything still has to be refunded to a customer after that, you do so yourself in Mollie.
Personal data. Of a deposit, we only store Mollie's payment reference, the amount, the status, the refund and the text your customer saw beforehand, with the appointment; these are deleted together with the appointment (article 4.5). Card and bank details of your customers never reach us. Mollie processes the payment data as an independent controller. State in your privacy statement that you use Mollie.
Mollie. Payments run via Mollie B.V., Keizersgracht 126, 1015 CW Amsterdam, KvK 30204462. Mollie is licensed by and supervised by De Nederlandsche Bank (the Dutch central bank) as an electronic money institution and payment institution, relation number F0038.
4.7 Tip een vakgenoot (refer a fellow tradesperson)
As a customer with a paid website, you get a personal referral link in your account. If someone starts a website with us via that link and pays within 60 days after the website was started via that link, you and the new customer each receive 3 changes by us (article 4.3).
We add the changes to both accounts as soon as the withdrawal period of the new customer's first payment (14 days) is over. If the new customer withdraws from the contract, or that payment is fully refunded or reversed before the reward is given, the reward lapses for both. A reward you already received, we do not take back.
You receive the reward at most 10 times per calendar year. A second website of your own, or a website for the same business, does not count. We see this from the same KvK number, or from the same email domain if that is the domain of your business. A shared domain such as gmail.com or hotmail.com says nothing about this and does not count.
The changes have no monetary value, are not paid out and do not expire. They do lapse with your contract (article 4.3).
You can create a new link in your account; the old link then no longer works for new referrals. We may change or end this scheme for new referrals, with one month's prior notice. Rewards you already received remain. A referral that was already running before the change takes effect (the new customer had already started via your link) still receives the reward under the rules that applied then.
5. Your domain name
- We register your domain name in your name, via our domain partner (Openprovider), with the registry of the extension: SIDN for .nl, EURid for .eu, DNS Belgium for .be, DENIC for .de, AFNIC for .fr, nic.at for .at and Verisign for .com. You are the holder. The holder terms of that registry also apply to your domain name (for .com: ICANN's rules for holders). When you order, the link is shown. For .nl you separately agree to SIDN's terms; for the other extensions your tick for these terms covers them too. A registry may set requirements for the holder: a .de domain name is only possible if you live or are established in Germany; that is why we only offer it then.
- Your details must be correct: your real name and a street address (not a PO box). If anything changes, let us know.
- Which details of the holder are public in the WHOIS is decided by the registry. For .nl, the name of a business holder is public; we cannot shield that.
- A domain name is registered and renewed per year. As long as you are our customer, we renew your domain name. Also if your payment is late or your website has been suspended. If you have cancelled, your domain name keeps working until the end of your hosting; after that we no longer renew it (article 10.2).
- If you want to transfer your domain name to another party, you ask us for the transfer code (token). You receive it within 5 days. How long the code is valid is decided by the registry. If it has expired, you ask for a new one.
- If you connect your own domain name, it stays with your own registrar. You pay for it and renew it yourself. You also make sure the DNS settings are correct.
6. AI texts, images and your responsibility
- The texts of your website are written by AI, based on the facts you fill in. Our system tries to stop invented facts, such as figures, years, quality marks and promises that you did not fill in. That does not always work: AI can make mistakes.
- Read your website carefully before you give your approval. You are responsible for what is on your website, including the AI texts you have approved. Also think of details required by law, such as your KvK number.
- If you upload your own images or texts, you must have the right to use them. This also applies to recognisable people in photos. If someone complains to us about your material, we may remove it.
- Images we offer (stock photos) you use on your website with us. The photos on your website are also in your export (article 10.1). There you may continue to use them for your own website, under the licence of the photo library included in the export. They do not show your own business, team or work. So do not use them as if they do.
7. What is not allowed
You may not use your website for:
- content or activities that are prohibited;
- phishing, fraud or fake shops;
- pretending to be someone else or another business;
- malware or spam;
- sex or porn;
- hate, discrimination or threats;
- infringement of the rights of others.
Checks. Our system automatically checks websites and changes for signs of abuse: words and patterns that point to something from 7.1, instructions to the AI, imitated brands, and reports via "Report abuse". If we switch this on, an AI model also assesses websites that the system flagged. A flag from the system never has a consequence by itself: a person looks at it and decides. Only input that is clearly not allowed, such as instructions to the AI or pretending to be a well-known brand, is refused by the system immediately when it is entered; you can then phrase it differently. We only put a flagged website or change online once a person has looked at it. In addition, a person checks every new website, within one working day after it goes online. We only refuse or restrict a website for a reason from this article.
If a person sees abuse, we may suspend your website or take it offline immediately, also without prior warning. We let you know by email, with:
- what we saw (the facts);
- which rule from these terms or which law it concerns;
- whether an automated check was involved;
- what we restrict and for how long;
- how you can object.
If you do not agree, email hallo@tegnest.com. We then look again and let you know what we decide. You can also go to court. In the case of serious abuse we may end the contract immediately. A business customer then gets nothing back. If you are a consumer, money paid in advance is not forfeited: what you paid for the time after the end and for bought changes you did not use, we refund within 14 days, unless and to the extent that we have a counterclaim the law allows. We then explain it to you. Where necessary, we report it to the police or other authorities.
If we suspect a criminal offence involving a threat to someone's life or safety, we report it immediately to the police (article 18 of the Digital Services Act (Digitaledienstenverordening, DSA)).
8. Term, renewal and cancellation
Hosting runs per year, counted from the day your first payment succeeds.
If you do not cancel, we automatically renew the hosting and your add-ons for one year. We then collect the price for the new year using your mandate. For consumers, article B3 applies.
We send you a reminder 30 days and 7 days before the renewal date.
You can cancel:
- in your account;
- with the form "Cancel contracts here" at tegnest.com/cancel, without logging in (in Dutch "Contract hier opzeggen" at /nl/opzeggen, in German "Verträge hier kündigen" at /de/kuendigen, with the button "jetzt kündigen", in French "Résilier le contrat ici" at /fr/resiliation). You find it at the bottom of every page of our website and of your account;
- or by email to hallo@tegnest.com.
A business customer can cancel at any time up to the renewal date; the website then stays online until the end of the paid year. For consumers, article B3 applies: they can always cancel, also with immediate effect. With the form you choose what you cancel (the whole contract or an add-on), an ordinary or an extraordinary termination (with the reason), and when (as soon as possible, or on a date). As soon as possible is, for a consumer, the day we receive the cancellation, and for a business customer the end of the paid year. You immediately receive an acknowledgement of receipt by email with what you sent, the date and the time, and when your contract is to end according to your cancellation. If we can link your cancellation to your contract straight away (the whole contract, cancelled in the ordinary way at the end of the paid year, with the email address of your account and the name of your website), the end date is already in that confirmation. Otherwise a person looks at it and we email you the end date and what you get back within 5 working days; the date on which we received your cancellation remains decisive. We assess an extraordinary termination first; the acknowledgement of receipt does not mean that we accept the reason.
Business customers: you do not get a paid year back, not even if you stop earlier. This also applies to the website itself, once it is online.
9. Late payment
- If the direct debit for a new year fails, we let you know. You can then still pay.
- Your website stays online for another 14 days.
- If you have not paid after those 14 days, we suspend your website. This happens automatically. Visitors then see a notice. We do not delete anything yet. After payment we switch your website back on. If you think the suspension is wrong, for example because you already paid or disagree with the amount, email us. A person then looks at it, you can give your point of view, and we let you know what we decide. You do not have to pay first for that.
- If you still have not paid 60 days after your website was suspended, we may end the contract. On day 45 you receive a warning about this. A person on our team decides about ending it, not a computer: we first check whether anything argues against it, such as a dispute about the payment, a message from you or a payment that is on its way. After that it continues as in article 10.
- Business customers who pay late owe the statutory commercial interest and the collection costs in accordance with the law. For consumers, article B4 applies.
10. After the end of the contract
- In your account you download an export of your website: a working copy (pages, layout and the images on them) plus your texts and details. You can put it online yourself with another party. This is possible as long as your website is running with us, and up to 30 days after the end of your hosting. The software of the platform is not included.
- If you want to keep your domain name, ask for the transfer code (article 5.5) and transfer it. If you cancel, your domain name keeps working until the end of your hosting, and so does email forwarding. If the registration would expire earlier, we renew it once more, at our expense. This costs you nothing. After the end of your hosting we no longer renew the domain name. It then lapses on the expiry date of the registration. We state the dates in the confirmation of your cancellation. After the expiry date, the registry holds it for a while (for .nl, SIDN holds it for 38 days); restoring it then costs extra. How long that is, is decided by the registry. If the contract ends in another way, we no longer renew the domain name from that moment.
- Your website goes offline. Email forwarding (article 4.1) also stops. 30 days after the end of your hosting (the export period of 10.1) we put your website in an archive. 90 days after that we delete your website and the data belonging to it. Until it is archived, you can restart your website in your account with a new payment. After that, until deletion, you can still ask by email for an export or ask for your website to be restarted.
- We keep invoices and payment data longer, because tax law requires this (usually 7 years).
11. Rights to the website
- The software, templates, designs and the platform remain ours. As long as your hosting runs, you may use them for your website. You may also use and adapt the export from article 10.1 after that for your own website, but not sell or give it away as a template for other websites.
- The texts you fill in yourself and the images you upload yourself remain yours. You give us permission to use them for your website.
- You may freely use the texts the platform wrote for you, also after the end of the contract. Rights do not always exist in texts written by AI. Insofar as those rights exist and belong to us, we transfer them to you as soon as you have paid.
12. Personal data
- How we handle your data as a customer (account, payment, domain) is set out in our privacy statement: https://tegnest.com/privacy.
- Your website may receive data of visitors, for example via the contact form. You are then the controller and we are the processor. The data processing agreement applies to this. It forms part of these terms.
- The platform creates a short privacy statement on your website. You check whether it is correct for your business.
13. Liability
This article (13.1 up to and including 13.5) only applies to business customers. For consumers, article B6 applies.
- If we are liable towards a business customer, this is limited to the amount you paid us in the 12 months before the damage (excl. VAT).
- We are not liable for indirect damage, such as lost turnover, lost customers, reputational damage or lost data. Nor for damage caused by errors in texts you approved, or by outages at other parties.
- These limitations do not apply if the damage is caused by intent or deliberate recklessness on our part.
- Report damage as soon as possible by email, and no later than 12 months after you discovered it.
- You indemnify us against claims by others that arise directly from content or material you supplied or published and that is unlawful. Not for our own fault or a defect in our service. We tell you about such a claim promptly, give you the chance to take part in the defence and do not settle at your expense without your consent.
14. Force majeure
If we cannot do our work because of something that, under the law, cannot be attributed to us (force majeure, article 6:75 of the Dutch Civil Code (BW)), our obligations are postponed for as long as that lasts. An outage at a supplier, a cyberattack or illness is not automatically force majeure: that depends on what happened and what we could have done. If the force majeure lasts longer than 60 days, either of us may end the contract. What you paid in advance for the time in which we did not deliver and for the time after that, you then get back per day. If you are a consumer, you do not have to wait for those 60 days: you can always cancel (article B3), and your statutory rights for a service that does not work as agreed (repair, price reduction, termination) remain. You do not pay for the time in which we did not deliver.
15. Changes to these terms
We only change these terms for a valid reason: a new law or ruling, a change at a supplier, a new or changed feature, or to make something clearer. We announce important changes at least 30 days in advance by email, with what changes and from which date. They apply from your next renewal date that falls at least 30 days after that email. If a change is to your disadvantage, you can end the contract before it takes effect. This costs nothing: what you paid in advance for the period after that, you get back per day. If you are a consumer and the service itself changes in a way that is more than slightly negative for how you can use it, you can also terminate the contract free of charge within 30 days after receiving our message or, if that is later, within 30 days after the change was made (article 7:50al BW). This does not apply if you can keep the service unchanged at no extra cost. If something changes in the service itself, you pay nothing extra for that change. Small changes that are not to your disadvantage, or changes required by law, may apply earlier.
16. Complaints, law and court
- If you have a complaint, email hallo@tegnest.com. We respond within 14 days: with an answer, or with what we are still looking into and when you will hear from us. We are not affiliated with a disputes committee. If we cannot resolve it together, you can go to court. Our point of contact for authorities of EU member states, the European Commission and the Digital Services Coordinator, and for everyone who uses our service (articles 11 and 12 of the Digital Services Act), is also hallo@tegnest.com. You can write to us in Dutch, English, German or French.
- This contract is governed by Dutch law. If you are a consumer and we direct our activities to the country where you live, you additionally keep the protection of the mandatory rules of that country. These terms are available in Dutch, English, German and French. The Dutch text is the original. All versions apply; if they differ, the text most favourable to you applies. This does not take away any rights you have as a consumer. As a consumer, you can go to the court that has jurisdiction under the rules (article B7).
- In a dispute with a business customer, the court in the district of Overijssel decides. For consumers, article B7 applies.
Part B — additional rules for consumers
B1. Prices
You always see prices including the VAT that applies to you (see the table in article 3). If you live in the Netherlands, that is 21%. If you live in another EU country, it is also 21% Dutch VAT, as long as our sales to consumers in other EU countries are not more than €10,000 this year and last year. Above that, it is the VAT of your country, from the sale with which we cross that threshold; you then see it when ordering and at every renewal. For a price per year, you also see what that comes to per month. No costs are added that you did not see beforehand. With a new domain name, the registration is a separate service that you pay separately, as its own line in your first payment (€14.51 incl. VAT; the first year of hosting then costs that much less); if you withdraw after it has been registered, we withhold that amount (article 3.6 and B2.3). This is also shown when ordering, above the payment button.
B2. Right of withdrawal (withdrawal period of 14 days)
You can withdraw from the contract within 14 days without giving a reason. The withdrawal period (cooling-off period) expires 14 days after the day on which the contract is formed (article 2.6). If you pay on 1 March, you can withdraw up to and including 15 March.
Starting immediately. We only start within those 14 days if you expressly ask us to when ordering. You do this with a tick box. That tick box covers your website, your hosting and the registration of your domain name. If you order add-ons straight away (article 4.5), their set-up counts as part of your website and their annual amount as part of your hosting. With that tick box you also indicate that you know:
- that you lose your right of withdrawal for the website as soon as it is completely finished and online;
- that you lose your right of withdrawal for the domain name as soon as it has been registered in your name;
- that you pay for the hosting up to the moment you withdraw.
What do you get back? What you paid, minus:
- the registration of your domain name (€14.51 incl. VAT, its own line in your first payment), if it has already been registered;
- the hosting and the annual amount of your add-ons up to and including the day of your withdrawal (pro rata, per day). The registration of the domain name is not included in that;
- the price of the website and the set-up of your add-ons, minus the discount of a package, only if your website was already online.
We charge the hosting per day, counting both the day of your payment and the day of your withdrawal. Example: you order a 1-page website (€67.76 incl. VAT), pay on 1 March and withdraw on 10 March. Your domain name has been registered, your website is not yet online. Your first payment shows the hosting (€29.05) and the registration of your domain name (€14.51) as separate lines. You get back: €67.76 − €14.51 for the domain name − 10/365 × €29.05 hosting (€0.79) = €52.46.
Your domain name remains yours. You remain the holder. You receive the transfer code within 5 days, so that you can transfer the name to another party (article 5.5). If you do not transfer it, we do not renew it and it lapses at the end of the registration period.
How to withdraw:
- with the form at https://tegnest.com/withdraw, without logging in. You choose what you withdraw from: the whole contract, an add-on or bought changes;
- with the button "Withdraw from the agreement" in your account, as long as your withdrawal period of 14 days is running;
- or with an email to hallo@tegnest.com;
- or with the model withdrawal form in the annex below. You may use that form, but you do not have to.
With the form you immediately receive an acknowledgement of receipt by email, with your statement, the date and the time. We then look up your order and you receive a confirmation of what you get back. The form always remains available, also after 14 days: sometimes your withdrawal period runs longer, for example if you did not receive all the information when ordering (article 6:230o paragraph 2 BW). If you send the same thing again within an hour, the first time counts. If more than 10 confirmations already went to the same email address on one day, we still store your withdrawal with the moment of sending, but do not email the confirmation; the page then shows it, to keep as a file. If more than 50 requests come in on one day from the same connection, the page asks you to email your withdrawal; in that case too, the moment of sending counts.
You are in time if you send your withdrawal before the end of the withdrawal period. If we read your email or form later, the moment of sending still applies.
We confirm your withdrawal immediately by email. We refund within 14 days after your withdrawal, using the same method you paid with. We also stop the mandate for automatic payment (direct debit or credit card) and take your website offline.
Packages of changes that you buy (AI changes or changes by us, article 4.3) are each a separate order, with their own withdrawal period of 14 days. It starts on the day your payment succeeded.
- Using them immediately. When buying, you tick this box: "I want to be able to use my bought changes immediately, also within the withdrawal period of 14 days. If I withdraw within 14 days, I only pay for the changes that have already been carried out (an AI change I applied, or a change by you that is finished), pro rata to the package amount, and I get the rest back. You only start after you have sent me the confirmation of this purchase by email." After your payment we send you that confirmation, with the text of the tick box, these terms and the data processing agreement (the version that applies to you) and the model withdrawal form, as a pdf. Only once that email has been sent can you use the changes.
- When has a change been used? An AI change: as soon as you click "Apply". A change by us: as soon as we have delivered it (article 4.3). If you get a change back (article 4.3), it counts as unused again. We count what was used at the moment your withdrawal came in: a change by us that we still delivered after that counts as unused. Which changes have been used, we count per kind as in article 4.3: first the included ones (of the month or the year), then the bought ones, the oldest purchase first.
- What do you get back? The part of what you paid that belongs to your unused changes from that purchase: pro rata to the whole purchase amount, rounded once to the cent in your favour. If you used none of them, you get everything back. Example: of the package of 3 changes by us (€24.20 incl. VAT), 1 has been carried out; you get 2/3 × €24.20 = €16.14 back. If you have sent us requests that have not yet been carried out, we cancel them (the newest first), so that they do not count as used; the acknowledgement of receipt lists them. You can no longer use the changes you get back afterwards. You pay for changes that have already been carried out.
- How to withdraw: with the form at https://tegnest.com/withdraw (also available after 14 days, see B2.5), with the button "Withdraw from purchase" under "Cooling-off period for bought changes" in your account, with an email to hallo@tegnest.com, or with the model form below. We confirm your withdrawal immediately by email and refund within 14 days, using the same method you paid with.
- If you withdraw from the whole contract (B2.1), then by law all your bought packages also end with it, even if their own withdrawal period is already over (article 6:230q paragraph 2 BW). Per package you get back what belongs to the unused changes, as above.
An add-on that you switch on later (article 4.5) is also a separate order, with its own withdrawal period of 14 days. It starts on the day your payment succeeded.
- Starting immediately. When switching it on, you tick this box (with the name of the add-on): "I want you to set up and switch on {naam} immediately, also within the withdrawal period of 14 days. I know that I lose my right of withdrawal for the set-up as soon as it is completely finished and on my website. If I withdraw within 14 days, I pay the annual amount pro rata up to and including the day of withdrawal, and the set-up only if it was already finished. You only start after you have sent me the confirmation of this purchase by email." After your payment we send you that confirmation, with the text of the tick box, these terms and the data processing agreement (the version that applies to you) and the model withdrawal form, as a pdf. Only once that email has been sent do we switch on the add-on.
- What do you get back? What you paid, minus the annual amount pro rata up to and including the day of your withdrawal (per day), and minus the set-up if it was already completely finished and on your website. The add-on is then switched off immediately.
- How to withdraw: with the form at https://tegnest.com/withdraw (also available after 14 days, see B2.5), with the button "Withdraw from purchase" under "Add-ons" in your account, with an email to hallo@tegnest.com, or with the model form below. We confirm your withdrawal immediately by email and refund within 14 days, using the same method you paid with.
- If you withdraw from the whole contract (B2.1), then by law all your add-ons also end with it, even if their own withdrawal period is already over (article 6:230q paragraph 2 BW). Per add-on you get back what you paid, minus the annual amount pro rata up to and including the day of your withdrawal, and minus the set-up if it was already finished.
B3. Renewal and cancellation
- You can cancel your hosting at any time, in the first year and after it (article 7:408 BW). You do not have to give a reason. You choose:
- at the end of the paid year: your website stays online until that date and you get nothing back;
- with immediate effect (or on an earlier date you choose): your website then goes offline and you get back the money for the hosting and the yearly amount of your add-ons for the days after that (pro rata, per day). What has already been done, you do pay for: building your website and setting up your add-ons, and the registration of your domain name for the first year (its own line in your first payment, as in B2.3). Your domain name remains yours (article 10).
- If you do not cancel, your hosting continues after the first year without a fixed end date. We collect the price per year in advance, but the payment for a year does not create a new fixed term: then too you can cancel at any time as in B3.1.
- If you stop before the end of a paid year, you get back the money for the days after your end date (pro rata, per day, rounded in your favour). If the next year was already paid, you get that back in full. We pay this back within 14 days after the end date, to your account. Unused bought changes we refund as in article 4.3.
- You can cancel in the same way you ordered: online in your account. It is also possible without logging in, with the form "Cancel contracts here" at tegnest.com/cancel (article 8.4; also in Dutch, German and French), or by email. With the form you choose an ordinary termination (as in B3.1) or an extraordinary termination (with the reason), and when your contract is to end; as soon as possible is the day we receive your cancellation. You immediately receive a confirmation by email with what you sent, the date and time, and when your contract is to end according to your cancellation; if a person has to look at it, the end date and what you get back follow within 5 working days. The date on which we received your cancellation remains decisive.
- Add-ons. B3.1 to B3.4 also apply per add-on (article 4.5). The first year of an add-on runs until the renewal date of your hosting, even if you switched it on halfway through the year. If you stop an add-on with immediate effect, you get back the yearly amount for the days after that (not the set-up). If you cancel your hosting, your add-ons stop at the same time.
B4. Late payment
If you pay late (also after a reversal, article 3.5), we first send you a free reminder. In it we give you 14 days to still pay, counted from the day after you received the reminder. Only if you have still not paid by then may we charge the statutory interest. We do not charge you collection costs. Article 9.2 up to and including 9.4 (suspending the website and ending the contract) also apply to you.
B5. Statutory guarantee
You are entitled to a website and hosting that do what you may expect. If something does not work as agreed, report it to us. We repair it free of charge and within a reasonable period. We cannot limit this statutory right.
B6. Liability
Article 13 does not apply to you. For you, the rules of the law on liability, compensation, limitation periods and reporting complaints in time apply. You do not indemnify us against damage for which we are responsible under the law. Your rights under article 82 of the GDPR (AVG) (compensation for a mistake with personal data) always remain.
B7. Disputes
If you cannot resolve a matter with us, you can go to the court that has jurisdiction under the law. Usually that is the court near where you live. Article 16.3 does not apply to you.
